What to Do Immediately After a Car Accident in New York

Being involved in a car accident can be frightening and disorienting — especially on busy New York streets. Knowing what to do in the first moments and hours after a crash can protect your health, preserve your legal rights, and help you navigate insurance and potential claims more effectively.

1. Stop and Ensure Safety

Under New York law, you are required to stop at the scene of any collision involving injury, death, or property damage. Leaving the scene before stopping and exchanging information is illegal and can result in criminal penalties.

Once stopped, if your vehicle is safely operable and it’s secure to do so, move it out of the flow of traffic — such as to the shoulder or a nearby parking area — and turn on your hazard lights to alert other drivers. If moving the car isn’t possible, remain at a safe place nearby until help arrives.

2. Check for Injuries and Call 911

Your safety and that of others should always be first. Check yourself and any passengers for injuries, even if nothing feels severe. Some injuries — like concussions, internal trauma, or whiplash — may not produce symptoms immediately. If anyone is hurt, call 911 right away. New York law generally requires that accidents resulting in injury or significant property damage be reported to law enforcement.

Even if no one appears injured, calling 911 is still a good idea so law enforcement can document the scene and file an official report.

3. Exchange Information With Other Parties

When it’s safe, exchange essential information with the other driver(s) involved. This includes:

  • Name and contact information
  • Driver’s license number
  • Vehicle registration
  • Insurance company and policy number

Although law enforcement often facilitates this exchange, it’s wise to write it down yourself and take photos if possible.

4. Document the Scene

Documentation at the scene can be invaluable later. If you are able:

  • Take photos or videos of vehicle damage from multiple angles
  • Capture the accident location, skid marks, traffic signals, and road conditions
  • Record the time, date, and weather conditions
  • Get contact information from witnesses

Good evidence at the outset can make a big difference when dealing with insurers or, if necessary, pursuing legal claims.

5. Police Report and Crash Form

If police respond, they will typically prepare an official accident report that notes the facts and any contributing factors. You should request a copy for your records. If police do not come to the scene, New York law still requires you to file a Report of Motor Vehicle Accident (Form MV-104) with the Department of Motor Vehicles within 10 days if the crash involved injury, death, or more than $1,000 in property damage. Failing to do so can lead to penalties, including possible suspension of your driver’s license.

6. Seek Medical Attention Promptly

Even if you feel fine, it’s wise to be evaluated by a medical professional as soon as possible. Some injuries don’t show symptoms right away. Medical records linking your injuries to the accident can be critical for personal injury claims and insurance benefits.

7. Notify Your Insurance Company

Report the accident to your insurance company promptly. Give basic facts — such as time, location, and parties involved — but avoid admitting fault or speculating about what happened. Insurance adjusters will investigate to determine liability.
